This article exists because citizens should know who is trying to influence their political opinions and votes. Advances in technology, social media, artificial intelligence, and digital advertising have made it easier than ever to disguise the true source of political messages or create misleading content designed to manipulate public opinion.
This article requires transparency about who is funding, creating, and distributing political communications while prohibiting deliberate deception about their origin or authenticity. At the same time, it fully protects freedom of speech, political advocacy, satire, journalism, and other forms of protected expression, ensuring that transparency is strengthened without limiting legitimate public debate.
Section 1 — Transparency and Authenticity
The People have a right to transparency regarding the source or sources, sponsorship, authorship, and authenticity of political communications intended to influence elections, legislation, public policy, or governmental action.
Section 2 — Protection Against Deceptive Political Manipulation
Congress and the States shall enact and maintain laws requiring disclosure of sponsored political communications and preventing material deception regarding the source, sponsorship, authorship, or authenticity of political communications.
Section 3 — Protection of Political Expression
Nothing in this Article shall be construed to abridge freedom of speech, freedom of the press, freedom of assembly, political advocacy, criticism, satire, opinion, artistic expression, or other forms of protected political expression.
