Article IX

 

This article exists to ensure that decisions about America's future are made by the American people, not by foreign governments, organizations, or interests. As technology, global finance, and international communication have expanded, concerns about foreign influence in elections, policymaking, and public debate have grown across the political spectrum. 


This article prohibits foreign actors from directing, funding, or materially influencing American political processes and requires transparency when foreign influence activities are detected. By strengthening safeguards against outside interference, it helps protect national self-government and public confidence that American democracy remains accountable to its own citizens.

  

ARTICLE IX — PREVENTION OF FOREIGN INFLUENCE


Section 1 — Political Self-Government

The political institutions and governmental processes of the United States derive their authority from the People of the United States and shall not be directed, controlled, or materially influenced by foreign powers, foreign persons, or foreign-controlled organizations.

  

Section 2 — Prohibition of Foreign Political Influence

Foreign powers, foreign persons, and foreign-controlled organizations shall not direct, control, finance, coordinate, or otherwise exercise material influence over the political processes of the United States.

  

Section 3 — Transparency and Enforcement

Congress shall enact and maintain laws necessary to identify, disclose, regulate, and prevent foreign influence over the political processes of the United States while preserving the freedoms guaranteed by this Constitution.

Such laws shall provide for public transparency regarding foreign-sponsored influence activities and for appropriate civil and criminal penalties for violations.
