This article exists to ensure that election results accurately reflect the will of the people and that Americans can trust the outcome of every election. Public confidence in elections has been weakened by concerns about gerrymandering, unequal voting power, election administration, security, and partisan interference.
This article requires that every vote carry equal weight, establishes national standards for election security and vote counting, and makes election systems transparent and auditable while protecting ballot secrecy. It also prohibits the manipulation of election rules, administration, or results for political advantage, helping ensure that elected officials are chosen by voters rather than by those who control the system.
Section 1 — Representative Legitimacy
Election systems shall produce outcomes reflective of the freely expressed preferences of the electorate and consistent with majority-supported democratic representation.
Section 2 — Equal Weight of Votes
Every vote shall carry substantially equal weight and shall not be diluted through electoral structure or administrative manipulation.
Section 3 — Election Security and Integrity
Congress shall enact and maintain uniform standards to ensure election security, ballot integrity, chain-of-custody protections, and accurate tabulation of votes.
Section 4 — Transparency and Auditability
Election systems shall be transparent, auditable, publicly reviewable, and designed to ensure public confidence in electoral outcomes while preserving ballot secrecy.
Section 5 — Protection Against Manipulation
No government entity or private actor shall intentionally manipulate election administration, ballot access, districting, or vote tabulation for partisan advantage.
Election results, certifications, vote tabulations, and ballot determinations may be altered or revised only pursuant to lawful procedures and upon verified evidence of material error, fraud, or illegality.
